Check your dispute first
Answer a few questions to see your options before writing your complaint.
Check your optionsIrish small claims can be useful for some lower-value consumer disputes, but it is not automatically worth it just because a trader ignored you or the situation feels unfair.
The better question is practical: is the amount meaningful, is the respondent identifiable, is the evidence strong, and does the dispute fit the official route?
TBD helps before court by organising the problem, writing clearly to the trader, and checking whether the route looks plausible. It does not provide legal advice, file claims, draft court forms, or tell you what to put into a court application.
What to do next
- 1Start by writing a clear complaint to the trader and keeping proof that you sent it.
- 2Check whether the amount, category, parties, respondent identity, and evidence are strong enough to justify more time.
- 3Use Courts.ie directly if you decide to file yourself, and remember that getting a decision is not always the same as getting paid.
When it may be worth it
Small claims may be worth considering where the amount is EUR2,000 or less, the dispute is about goods, services, minor property damage, or a limited deposit issue, and the trader is Ireland-based and identifiable.
It also helps if you can prove the amount with receipts, bank/card records, photos, emails, delivery records, or a simple timeline. A small but well-documented claim can be stronger than a larger claim full of vague frustration.
When to pause
Pause if the respondent is a private seller, the issue is really about injury, insurance, finance, leasing, debt, or a residential tenancy, or you cannot find a usable name and address for the respondent.
Also pause if what you mainly want is an apology, punishment, investigation, or compensation for stress. Those may be understandable feelings, but they are not the same as a clear small-claims money remedy.
Forum pattern
Public forum threads often ask the same question in different words: is it worth spending more time for EUR100, EUR300, or EUR500? That is a real product question, not just a legal one.
Before spending more time on a claim, consider the amount, your evidence, who you would claim against and whether you could recover the money if you won.
Before you write
- Amount is EUR2,000 or less
- Respondent legal name and address are identifiable
- Issue fits goods, services, minor damage, or a limited deposit route
- Evidence is written, dated, and easy to explain
- You have complained to the trader first
- No specialist route is clearly better
Questions people ask
Is small claims worth it for a small amount?
Sometimes. A low-value claim may still be worth it if the evidence is clear and the respondent is identifiable, but the time, fee, stress, and enforcement risk should be weighed first.
Can TBD tell me whether I will win?
No. TBD can help you organise the details and check your options. It cannot predict the result or give legal advice.
